Illegal Aliens Sue Wendy’s

Wendy's

It was only a matter of time. Illegal aliens have now discovered another favorite old trick of the liberal left–the malicious abuse of civil litigation in order to do an end run around the law and the United States Constitution.

The Associated Press reports that “A group of illegal immigrants who worked for Wendy’s International Inc. is suing the restaurant chain because the company fired them after discovering it had missed a deadline for joining a federal program that would have helped them attain legal status. The lawsuit, filed Friday in state district court in Houston, is a companion to a similar class-action suit filed last month in Dallas against Dublin, Ohio-based Wendy’s, its subsidiary Cafe Express and the Houston-based business law firm Boyar & Miller.”

According to AP, “The immigrants, who worked for Cafe Express, are seeking unspecified damages.Between the two lawsuits, 40 illegal immigrants say they were fired after the company recently found that Boyar & Miller, the law firm Wendy’s had hired, never filed paperwork for a 2001 legalization program that allowed immigrants with employer sponsorship or an American spouse to apply for citizenship. Once the discovery was made, Wendy’s was forced by law to fire the employees because of their illegal status. Immigrants in the program would have been insulated from being fired.”

Now, that’s fascinating. In other words, big capitalist outfits like Wendy’s are allowed to hire illegal Third World immigrants while they are still completely illegal so long as they set up a “legalization program” and INFORM THE FEDERAL AUTHORITIES that they have got so many illegals working for them. I never heard of this before and most Americans would be outraged about this. Jobs at fast food places used to provide first jobs for white teenagers or college students, but now that’s quickly becoming a thing of the past.

The AP article quoted illegal immigrant Daniel Olivares as saying, “‘I put all my hope and faith in this company…It was devastating news for me and my family.’ ….Attorneys for Olivares said the company deducted $25 from his weekly paycheck of $313.20 for 4 1/2 years to cover legal fees associated with the program. With the rest of his paycheck, Olivares said he helped support his sister, her two daughters and his ill mother in Mexico City.”

The issue of how much money should be paid to American workers is being undermined by the illegal flood. This is yet another horrifying aspect of what these people are doing to us. The article mentions in a casual aside that this Olivares Mexican has been in the United States illegally for FOURTEEN YEARS, during which he has apparently had no difficulty in obtaining work and has had no trouble of any kind with the castrated and impotent American immigration authorities. He has become so confident that he can actually sue his employers, who were also breaking the law, for embezzling his money and not coughing up the green card which would reward and validate both his crime and theirs.

As an aside, increasing numbers of advocacy groups for these criminals now exist and are beginning to clutter up the American courts with yet more lawsuits, often to prevent local municipalities such as Hazleton, Pennsylvania from enforcing the laws against their presence.
